    PLEASE NOTE: These terms and conditions must always be read together with our General Terms and Conditions and any other information contained on Mweb's legal notices page, which will always apply to your use of the Mweb Online Store.

    Mweb Online Store Terms

    1. General

    These are the terms that govern the relationship between you (“the customer”) and us (“Mweb/the Mweb Online Store”).

    By visiting the Mweb Online Store, you agree to be legally bound by these terms, and the applicable sections of Mweb’s General Terms and Conditions. Mweb reserves the right to amend these terms from time to time. Please check the terms periodically for changes. Your continued use of the Mweb Online Store following the posting of any changes to the terms constitutes your acceptance of those changes.

    2. Stock and availability

    2.1 All stock is limited and subject to availability and Mweb cannot guarantee availability of stock.

    2.2 Mweb shall take reasonable steps to ensure that product availability displayed on the Mweb Online Store is accurate, however, should products become unavailable after you have placed an order, Mweb will notify you and will refund any monies paid by you.

    2.3 Mweb shall take all reasonable steps to accurately reflect the description, availability, purchase price and delivery charges of products on the Mweb Online Store. However, should there be any errors of whatsoever nature on the Mweb Online Store (which are not due to our gross negligence), we shall not be liable for any loss, claim or expense relating to a transaction based on any error, save – in the case of any incorrect purchase price – to the extent of refunding you for any amount already paid.

    3. Pricing

    3.1 Prices are inclusive of VAT.

    3.2 Mweb reserves the right to amend pricing at its sole discretion and without notice.

    4. Payment

    4.1 Mweb accepts payment by debit and credit cards.

    4.2 You warrant that you are authorized to use the designated payment method and that you authorize us to charge your payment method for the total amount of your order. If the payment method cannot be verified, is invalid or is otherwise not acceptable, your order may be suspended or cancelled.

    4.3 Orders are deemed to be completed when full payment has been received by Mweb.

    5. Delivery

    5.1 Delivery is available throughout South Africa and can take up to 7 (seven) days for delivery in major cities and if you live outside of major cities, the order may be delivered to you within a reasonable period which may be longer than 7 (seven) days.

    5.2 The delivery fee will be applicable to all hardware products and will be calculated upon checkout.

    5.3 Mweb will notify you if we are unable to deliver the products during the delivery period. You may then, within 7 (seven) days of receiving such notification elect whether or not to cancel your order for the products. If you elect to cancel your order, we will reimburse you for the total amount of your order.

    5.4 Mweb’s obligation to deliver a product to you is fulfilled when we deliver the product to the physical address nominated by you for delivery of the order and Mweb shall not accept liability for any loss or unauthorised use of a product, after it has delivered the product to the physical address nominated by the customer.

    6. Returns and Refunds

    6.1 Hardware may be returned to us within 30 (thirty) days of purchasing, in its original packaging.

    6.2 Mweb will arrange to collect the product from you. Once we have inspected the product and validated your return, we will refund your account with the purchase price of the product.

    6.3 Software that has already been activated may not be returned unless it is defective.

    7. Software and Vouchers

    7.1 Software and vouchers are treated differently to other products when it comes to returns, given their digital nature and the fact that technical knowledge of vouchers and/or software registration process may be required to assist you if the voucher, software and/or link does not work. Once you purchase a voucher and/or software, we will only allow you to return it if it is defective.

    7.2 Any defect in a voucher and/or software or its link shall be dealt with as follows:

    7.2.1 Should you experience any problems in using the link to access the voucher and/or software or in utilising the links, please report the problem to us as soon as reasonably possible after you become aware of the problem, but in any event within 30 (thirty) days of purchase.

    7.2.2 We will then investigate the possible cause/s of the problem and how to rectify them. We may need to liaise with the relevant service providers to assess and rectify the problem or to issue you with a new link or voucher and/or software.

    7.2.3 If the voucher and/or software is defective, we will at your choice replace it (if such replacement is possible) or refund your account with the purchase price of the voucher and/or software.

    8. Cooling-off Period

    8.1 The Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) may be applicable to your relationship with Mweb.

    8.2 Section 44 of ECTA entitles customers to cancel some electronic transactions within the seven-day cooling-off period, without penalty.

    8.3 Products, including software and vouchers, must be unused and its original packaging with all attachments and accessories included.

    8.4 Software refunds will be made within 7 (seven) days from date of cancellation, in the form of credit added to the Mweb account unless requested otherwise.

    8.5 Hardware refunds will be made within 7 (seven) days from date of collection, in the form of credit added to the Mweb account unless requested otherwise.

    9. Products damaged on delivery

    9.1 Should a product be damaged or missing any parts or accessories at the time of delivery, please notify us within 7 (seven) days of such delivery.

    9.2 Mweb will arrange to collect the product from you. Once we have inspected the product and validated your return, we will repair / replace the product as soon as possible or refund your account with the purchase price of the product.

    10. Defective Products

    10.1 A defect is any material imperfection in the manufacture of a product or any characteristic of a product, which makes the product less acceptable than one would reasonably be entitled to expect in the circumstances.

    10.2 The following will not be regarded as defects and you will not be entitled to a return under clause 9.2:

    10.2.1 faults resulting from normal wear and tear;

    10.2.2 damage arising from negligence, user abuse or incorrect usage of the product;

    10.2.3 damage arising from electrical surges or sea air corrosion;

    10.2.4 damage arising from a failure to adequately care for the product;

    10.2.5 damage arising from unauthorized alterations to the product; and

    10.2.6 where the specifications of a product, although accurately described on the Mweb Online Store and generally fit for its intended purpose, do not suit you.

    11. Warranties

    11.1 Every customer has the right to receive products that are of good quality and free of defects.

    11.2 All products sold by Mweb carry an implied warranty as per the Consumer Protection Act 68 of 2008, which allows customers to return defective products. In addition to this implied warranty, products may carry a manufacturer’s warranty. If you have received a product which turns out to be defective or otherwise of poor quality, please notify us as soon as reasonably possible after you become aware of the defect or poor quality, but in any event within 6 (six) months after delivery of the product (except in the case of an extended supplier or manufacturer warranty).

    11.3 Where there is no extended supplier warranty period, unfortunately we cannot facilitate returns that fall outside of the 6-month period referred to in clause 11.2.

    11.4 A product may have a supplier warranty that extends beyond the 6-month standard warranty. If such a product turns out to be defective more than 6 (six) months after delivery, please notify us as soon as reasonably possible after you become aware of the defect, but in any event within the extended supplier warranty period, if applicable, after delivery of the product.

    11.5 Please note that any extended supplier warranty is subject to terms and conditions the supplier or manufacturer may impose. These are usually stated in a brochure or leaflet inside or on the product packaging. It is your responsibility to make yourself aware of any such terms and conditions.

    11.6 It is also important to note that it will be in the supplier or manufacturer’s discretion what remedy it can offer you. Mweb is under no obligation to provide you with a credit, repair / replacement, as your remedy lies with the supplier or manufacturer.
