By downloading and/or accessing and using DStv and the services herein, you agree to be bound by the DStv Terms & Conditions which are available on the DStv website and as amended from time to time.
1. Interpretation In these DStv Terms & Conditions
1.1. "Connect ID” means a registration / profile that belongs to a digital user;
1.2. “Video Content” means audio and/or audio-visual programming which is selected and made available by MultiChoice on DStv;
1.3. "Device" means the computer and/or mobile device that can be used for viewing and/or downloading DStv and its Content;
1.4. “Download" means to transfer Video Content onto the DStv Customer’s Device for subsequent access and use for a limited time period and "Downloaded" has a corresponding meaning;
1.5. "DStv" means the service offered by MultiChoice made available through an application and a website and which allows the User to access Live TV, DStv Catch Up; DStv Kids, My DStv (Self Service) and/or the TV Guide;
1.6. “DStv Premium, DStv Compact Plus, DStv Compact, DStv Family, DStv Access and/or DStv EasyView” means the package of audio-visual and audio channels referred to as such by MultiChoice, and includes any package which MultiChoice determines should replace those packages from time to time;
1.7. "MultiChoice Service" means the subscription-based broadcasting service comprising the bouquets and associated services, features, facilities and applications and any additional functionalities provided by MultiChoice to DStv Customers in accordance with the Subscription Terms and Conditions;
1.8. “MultiChoice” means MultiChoice Support Services (Proprietary) Limited and its affiliates;
1.9. “Subscription Agreement” means the agreement between MultiChoice/Mweb and its customers, as amended from time to time, which sets out the terms and conditions on which the customer is authorized to access the DStv Service in exchange for payment of the applicable subscription fee;
1.10. “Internet Service Provider” or “Mweb” means Mweb (Pty) Ltd;
1.11. “Activation Date" means for purposes of the Mweb DStv Service, the date on which you activate the DStv Service with your Mweb activation code on the DStv Website;
1.12. "Mweb DStv Service" means the reselling of the Multichoice DStv Streaming Service to Mweb Subscribers;
1.13. "Service Fee" means the amount which we will charge you for the Mweb DStv Service selected by you as recorded in the Application Form and/or displayed on our Website;
1.14. "DStv Service" means the provisioning of the DStv Streaming Service by Multichoice as more fully described in the Multichoice Provider Terms;
1.15. "DStv Provider" means the third party providing the DStv Streaming Service as indicated on the DStv Website;
1.16. "DStv Provider Terms" means the DStv Terms and Conditions, the DStv Website Terms, the DStv Privacy Policy and the DStv License Agreement (in respect of the DStv Application if used), as indicated on the DStv Website from time to time.
2. Eligibility to Access and Use DStv
2.1. DStv is available to Mweb Subscribers to access DStv on their Devices in accordance with these Terms and Conditions.
2.2. MultiChoice and Mweb may take measures, including technological measures, to ensure that it provides the service only to persons who meet the eligibility criteria in these Terms and Conditions.
2.3. As Mweb is acting as a reseller of the DStv Service for your convenience and for purposes of providing you with one bill, you are required:
2.3.1. to have the minimum requirements and equipment as defined by the DStv Provider on the DStv Website and DStv Provider Terms. Such requirements are found on the DStv Website from time to time which is currently located at https://www.dstv.com/en-za/news/3717/getting-started-with-dstv-streaming and dstv-now-to-dstv-tcs_dec-2020.pdf;
2.3.2. to register on the DStv Website and accept and agree to all the DStv Provider Terms which are applicable to the DStv Service to use the Mweb DStv Service correctly and as prescribed in the DStv Provider Terms.
2.4. Provision of the Mweb DStv Service is subject thereto that the DStv Service provider must accept your registration on the DStv Website.
3. The Sign-Up Process
3.1. In order to access DStv, you will be required to have a valid Connect ID; or a person granted permission to access DStv by such Customer and complete the registration process. Only the first four Devices on which you sign in with a valid Connect ID will automatically be registered. Of the four Registered Devices, only one device can simultaneously view Streaming Video Content. Registered Devices can be changed on DStv every six months.
3.2. You must have an active and up to date account with Mweb.
3.3. You will be required to sign up to the DStv service on the Mweb website.
3.4. You will receive the Connect ID and login instructions from the DStv Provider.
3.5. You will be required to manage your DStv account through Mweb, that is any queries relating to activation, suspension, re-connection or termination of the DStv service.
3.6. You will be required to register on the DStv Website and accept and agree to all the DStv Provider Terms. Mweb has no control over this process and accordingly cannot be held liable should you suffer any damage as a result of such registration process and flowing from your acceptance of the DStv Provider Terms or failure by the DStv Provider to accept your registration.
3.7. The Mweb DStv Service will, unless otherwise specifically indicated in any promotional offer and/or on the Application Form, be on a month-to-month basis.
3.8. Should you experience a problem with the Mweb DStv Service you will be entitled to call our support call centre who will address all billing issues but may, if needs be, refer you to the DStv Service Provider for support related to the DStv Service
4. Service Fees and Billing
4.1. You as the user are liable to Mweb for the Service Fee and you consent to us debiting your Mweb account with the Service Fee.
4.2. We will charge and directly bill the Service Fee to your Mweb account, as from Activation Date. Unless otherwise indicated in these Mweb DStv Service Terms and Conditions payment will be effected as per clause 8 of the General Terms and Conditions.
4.3. We may provide promotional offers or discounted Service Fee(s), whether on a fixed term contract or month to month basis, from time to time in respect of particular Mweb Selected Connectivity Products linked to the Mweb DStv Service. In such event, should you at any time cease to be a validly paid up Subscriber to the particular Mweb Selected Connectivity Product which is linked to the promotional offer and/or discounted Service Fee(s) (whether due to failure to pay the Service Fees, or by upgrading or downgrading to another Mweb Selected Connectivity Product or by terminating the particular product) or cancel any fixed term contract before the expiry date, Mweb may adjust the Service Fee to that of the standard Service Fee payable or charge you a reasonably cancellation fee with due consideration to the discounted Service Fee(s) or promotion granted.
4.4. In the event of your upgrading or downgrading of the Mweb Selected Connectivity Product to another connectivity product you may not be eligible for this Mweb DStv Service or may lose the discounted Service Fee (s) or promotion related to the initial Mweb Selected Connectivity Product subscribed to by you.
4.5. When you sign-up and/or activate the Mweb DStv Service you may be eligible for a limited free access period and you may be allowed to cancel before the end of the free access period, failing which the Mweb DStv Service and billing will automatically commence after the free access period without further notice to you.
4.6. Invoicing information will be disabled on My DSTV for customers who sign up via Mweb. Invoicing information can be accessed via Mweb.
5. Minimum Technical Specifications
5.1. In order to access and use DStv, you must, at your own cost, meet MultiChoice’s minimum technical specifications, the latest of which, can be viewed on dstv.com
5.2. Without limiting the generality of clause
5.3. above, you must, at your own cost –
5.3.1. acquire access to, install and maintain the specified hardware (including the Device), applications and telecommunications facilities;
5.3.2. as it relates to the DStv application, install the DStv application and upgrade as and when new versions are released;
5.3.3. obtain broadband Internet access from an Internet Service Provider with a minimum speed of 2Mbps;
5.3.4. ensure that the User has sufficient Download capacity available on the User’s Device should the User choose to Download Content;
5.3.5. maintain the required hardware (including the Device), systems, software, telecommunications facilities and reliable Internet access services.
5.4. Mweb and MultiChoice will not be responsible for –
5.4.1. `any failure, delay or lack of ability within MultiChoice’s operating platforms in the delivery of the Content or the accessing of DStv and/or its services; or
5.4.2. any loss (including loss of data), damage (including damage to the User’s hardware and your Device), costs or expenses suffered or incurred by you directly or indirectly as a result of your failure to properly install the hardware or software, or due to any incompatibility of the your Device with DStv or any of its services.
5.5. Mweb and MultiChoice will not be responsible for any loss, damage, costs or expenses suffered or incurred by you due to factors beyond its reasonable control including, without limitation, Internet congestion, slow Internet connectivity, the operation of "cookies", temporary Internet files, firewalls, proxy servers, pop up blockers or other files/software on your Device. It is your responsibility to manage your hardware and to remove any impediments to the proper functioning of DStv and its services. You are, however, cautioned against taking any steps which could render you or your hardware vulnerable to any risks including, without limitation, viruses or spam, and you do so at the your own risk.
6. Support
6.1. Should the User experience any difficulties with any aspect of the DStv Service, the User may contact Mweb by calling 087 700 2121 for Billing Queries, 087 700 0777 for Technical Queries, or emailing MultiChoice/DStv on DStvNowSupport@dstv.com, calling 011 289 2222 on any technical queries related to My DStv App, or in any other manner indicated by Mweb from time to time.
7. Termination of these DStv Terms & Conditions
7.1. Your failure to comply with these DStv Terms & Conditions constitutes a material breach of these DStv Terms & Conditions.
7.2. If you become ineligible to access the Services, or breaches these DStv Terms & Conditions, MultiChoice/Mweb may, without prejudice to any other remedy MultiChoice/Mweb may have, terminate the DStv Customer and/or User’s ability to access DStv and its services, and remove all Content stored on the DStv Customer’s and/or your Device. If, and to the extent that MultiChoice/Mweb is required by any Applicable Law, or if MultiChoice/Mweb otherwise consider it appropriate, MultiChoice/Mweb will notify you prior to exercising MultiChoice/ Mweb’s rights in terms of this clause.
7.3. Mweb is acting as a reseller of the DStv Service and providing the Mweb DStv Service for your convenience and for purposes of providing you with one bill. Termination of your Mweb Selected Connectivity Product or other Mweb products, will not automatically result in cancellation of the Mweb DStv Service and we will continue to bill you for the Mweb DStv Service unless you also terminate the Mweb DStv Service in accordance with these Mweb DStv Service Terms read with our General Terms and Conditions.
7.4. If your Mweb Selected DStv Service is not paid up to date from time to time, it will be suspended. In the event of any suspension, your Mweb DStv Service may also be terminated.
7.5. Termination may be effected in terms of our General Terms and Conditions. Upon termination the Service Fee will not be pro-rated and you will be liable for the Service Fee for the notice period including the whole of the last calendar month.
8. Warranties, consents and limitation of liability
8.1. Mweb does not warrant that the Mweb Selected Connectivity Product which you are subscribed to are meeting the DStv Service recommendations or is fit for use in conjunction with the DStv Service.
8.2. Subject to limitations allowed in law, Mweb will not be liable to you, or any third party, for any loss or damages of whatsoever nature, including without limitation, any direct, indirect or consequential or other damages, arising out of your use of the Mweb DStv Service, including without limitation: (a) any unavailability, delay, interference with or interruption of the Mweb DStv Service and/or failure of the Mweb Selected Connectivity Product to meet the DStv Internet recommendations; or (b) termination or suspension of the Mweb DStv Service; or (c) failure to register you as a subscriber on the DStv Website; or (d) your use of the Mweb DStv Service in contravention of the DStv Provider Terms or law. You indemnify Mweb against all loss, damages, claims or liabilities of whatsoever nature as a result of any claim instituted by a third party (other than you) arising from your use of the Mweb DStv Service including without limitation those arising from (a) to (d) above.
8.3. Subject to applicable law, you consent that information that you provide to us, may be used by us (and may be provided to the DStv Service Provider but only to the extent strictly necessary) for the purposes of: (a) providing Mweb DStv Service which you require and specifically for billing purposes; (b) checking credit and verifying payments; (c) informing you of product developments and operational messages; (d) investigating suspected fraudulent activities, security, legal purposes and investigating complaints. In particular you are referred to the DStv Privacy Policy and by registering on the DStv Website you consent to the use of your information as indicated by the DStv Service Provider.
